IT'S A TIME TO HONOR THE STRENGTH OF SURVIVORS, SUPPORT THOSE CURRENTLY BATTLING THE DISEASE AND REMEMBER THE LIVES THAT HAVE BEEN LOST. LET'S STAND TOGETHER WITH ALL WHO HAVE BEEN TOUCHED BY BREAST CANCER AND CONTINUE TO SUPPORT EFFORTS FOR PREVENTION, HOPE, AND HEALING. IN ADDITION, WE WANT TO RECOGNIZE THAT OCTOBER IS ALSO PRINCIPAL APPRECIATION MONTH. WHILE SPANISH IS THE LARGEST LANGUAGE GROUP IN TEXAS AFTER ENGLISH, CARROLL IS UNIQUE AND MANDARIN IS OUR SECOND MOST FREQUENT LANGUAGE WITH SPANISH FOLLOWING THAT. OF THOSE STUDENTS TESTED, 78 NEW STUDENTS WERE IDENTIFIED AS EMERGENT BILINGUAL AND WERE SERVED BY OUR ESL DEPARTMENT. ON THE GRAPH, YOU CAN SEE IN GREEN THE STUDENTS THAT ARE ACTIVE, EMERGENT BILINGUAL, AND IN BLACK ARE THE STUDENTS THAT HAVE ALL READY MET ENGLISH PROFICIENCY AND HAVE EXITED OUR ESL PROGRAM, AND WE MONITOR THEM FOR THE NEXT TWO YEARS. WHEREAS THE DISTRICT HAS FULLY COOPERATED WITH THE GOVERNMENT'S INVESTIGATION OVER THE LAST THREE YEARS, PROVIDED THOUSANDS OF PAGES OF EVIDENCE THAT DEMONSTRATES CISD'S LEGAL COMPLIANCE WITH CIVIL RIGHTS LAWS AND SPENT THOUSANDS OF STAFF HOURS IN MORE THAN $320,000 IN COMMUNITY TAX DOLLARS. WHEREAS THE BOARD HAS THOROUGHLY REVIEWED THE DISTRICT'S HANDLING OF THESE GRIEVANCES AND FIRMLY STANDS BEHIND THE TEACHERS, PRINCIPALS, COUNSELORS, AND ADMINISTRATORS WHO CONDUCTED TIMELY AND EFFECTIVE INVESTIGATIONS, IMPOSED APPROPRIATE DISCIPLINE WHERE NECESSARY, AND ENSURED FULL COMPLIANCE WITH CIVIL RIGHTS LAWS. WHEREAS THE DISTRICT'S OBLIGATIONS TO PROTECT PRIVACY RIGHTS BY THE LIMITING DISCLOSURE OF EVIDENCE IN INDIVIDUAL CASES HAS CREATED PUBLIC CONFUSION AND PLACED DISTRICT STAFF MEMBERS AND EDUCATORS AT A SEVERE DISADVANTAGE, BURDENING THEM WITH FALSE MISREPRESENTATIONS THAT CANNOT BE CORRECT. WHEREAS ON MAY 6, 2024, THE DISTRICT RECEIVED A LETTER FROM THE GOVERNMENT STATING THAT IT HAD COMPLETED ITS INVESTIGATIONS, ALONG WITH A PROPOSED RESOLUTION AGREEMENT AND A 90 DAY RESPONSE DEADLINE. WHEREAS THE GOVERNMENT, DESPITE MULTIPLE REQUESTS BY THE DISTRICT, REFUSED TO PROVIDE ANY OF THE FINDINGS OR EVIDENCE FROM ITS THREE YEAR LONG INVESTIGATION THAT ALLEGEDLY SUPPORTED THE PROPOSED RESOLUTION. WHEREAS AFTER EVALUATING THE NEARLY 20 PAGE PROPOSED RESOLUTION, THE DISTRICT DETERMINED THAT ACCEPTING IT WOULD UNJUSTIFIABLY IMPOSE ONEROUS OBLIGATIONS THAT EXTEND BEYOND THE DISTRICT'S ALREADY COMPLEX AND ADMINISTRATIVELY BURDENSOME OBLIGATIONS UNDER EXISTING FEDERAL LAW, WITH WHICH THE DISTRICT HAS FULLY COMPLIED AND COST THE COMMUNITY EVEN MORE TAX DOLLARS. WHEREAS, ON AUGUST 5, 2024, AT THE END OF THE 90 DAY PERIOD, THE DISTRICT DECLARED A NEGOTIATION IMPASSE DUE TO THE LACK OF TRANSPARENCY AND COOPERATION FROM THE GOVERNMENT. WHEREAS, DURING A CONFERENCE CALL, ON SEPTEMBER 19, 2024, THE GOVERNMENT AGAIN REFUSED TO PROVIDE ANY OF ITS WRITTEN FINDINGS OR CONCLUSIONS AND FURTHER REFUSED TO DECLARE AN IMPASSE. INSTEAD, CHOOSING TO REOPEN THE INVESTIGATIONS AND REQUEST ADDITIONAL DOCUMENTATION FROM THE DISTRICT, PUNISHING THE DISTRICT BY BURDENING IN IT WITH INCREASED TAXPAYER EXPENSES AND THE FURTHER CONSUMPTION OF VALUABLE STAFF TIME. WHEREAS, THE GOVERNMENT'S REFUSAL TO DECLARE AN IMPASSE AS REQUIRED BY ITS OWN PROCEDURES, HAS PREVENTED THE PROCESS FROM MOVING FORWARD TO THE NEXT STEP, WHICH WOULD REQUIRE THE GOVERNMENT TO ISSUE A LETTER OF IMPENDING ENFORCEMENT ACTION AND FINALLY PROVIDING THE DISTRICT WITH ITS FINDINGS, CONCLUSIONS, AND EVIDENCE SUPPORTING THEM IN A WRITTEN STATEMENT OF THE CASE. WHEREAS THE DISTRICT IS CONCERNED, THE GOVERNMENT'S ACTIONS ARE IMPEDING PROGRESS TOWARD THE MUTUAL GOAL OF ENSURING EQUAL ACCESS TO HIGH QUALITY EDUCATION FOR ALL STUDENTS. WHEREAS THE DISTRICT REMAINS FULLY COMMITTED TO [01:10:01] PROMOTING A SAFE AND EFFECTIVE EDUCATIONAL ENVIRONMENT FOR ALL STUDENTS AND TO ENCOURAGING PARENTS AND STUDENTS TO BRING ANY AND ALL CONCERNS REGARDING DISCRIMINATION, HARASSMENT OR BULLYING TO THE ATTENTION OF THE DISTRICT OFFICIALS FOR PROMPT RESOLUTION. NOW, LET IT BE HEREBY RESOLVED THAT THE BOARD OF TRUSTEES DENOUNCES THE ACTIONS OF THE GOVERNMENT IN REOPENING THE ALREADY COMPLETED INVESTIGATIONS AND VIEWS, THIS DECISION AS A RETALIATORY MEASURE DESIGNED TO PUNISH THE DISTRICT FOR REFUSING TO BLINDLY SIGN A PROPOSED RESOLUTION WITHOUT ANY JUSTIFICATION AND FURTHER DESIGNED TO COERCE THE DISTRICT INTO AGREEING TO A COSTLY PROPOSED RESOLUTION IN ORDER TO AVOID THE COST OF COOPERATING IN THE RE-OPENED INVESTIGATION. THAT THE BOARD OF TRUSTEES URGES THE GOVERNMENT TO ABIDE BY ITS OWN POLICIES, DECLARE AN IMPASSE AND PROVIDE THE DISTRICT WITH A LETTER OF IMPENDING ENFORCEMENT ACTION AND STATEMENT OF THE CASE, SO THE FINDINGS, CONCLUSIONS, AND EVIDENCE FROM THE YEARS LONG INVESTIGATION MAY BE FINALLY REVIEWED BY THE BOARD OF TRUSTEES. IN THOSE 25 YEARS, I HAVE NEVER SEEN A PROCESS SO OPENLY ONE SIDED AND UNFAIR AS THIS PROCESS. WE HAVE SPENT THE LAST THREE YEARS COMPLYING WITH EVERY REQUEST THAT THE OCR HAS GIVEN US. AS YOU JUST SAID, WE'VE TURNED OVER THOUSANDS OF PAGES OF DOCUMENTS AT THE COST OF HUNDREDS OF THOUSANDS OF DOLLARS TO THIS DISTRICT. WE HAVE HIRED ATTORNEYS THAT HAVE COME THROUGH THE EVIDENCE. I MYSELF AND PROBABLY MANY OF THE TRUSTEES AND DOCTOR GLENN HAVE PROBABLY DONE THE SAME.I PERSONALLY HAVE READ EVERY PIECE OF PAPER THAT'S BEEN EXCHANGED BETWEEN THIS DISTRICT AND THE OCR, AND I HAVE DONE AN EXHAUSTIVE RESEARCH OF THE LAW. I PERSONALLY CAN SAY THAT IN EVERY ONE OF THESE CASES, EVERY TEACHER, ADMINISTRATOR, PRINCIPAL, AND COUNSELOR THAT ACTED IN THESE CASES, DID EVERYTHING IN ACCORDANCE WITH OUR POLICY, DID EVERYTHING IN ORDER TO PROTECT THE STUDENTS INVOLVED. THEY TIMELY INVESTIGATED THESE CASES, WHERE PUNISHMENT WAS NECESSARY, THEY METED IT OUT. IN EVERY SINGLE CASE, AFTER PUNISHMENT WAS METED OUT, WE HAD NO FURTHER ISSUES WITH ANY OF THE VICTIMS. THAT IS HOW A DISTRICT SHOULD HANDLE THESE THINGS, AND WE WENT ABOVE AND BEYOND, AND WE'VE HANDLED THEM, I'VE LOOKED AT THE EVIDENCE, AND WE'VE GONE BY THE BOOK. NOW, THIS PROCESS, WE HAVE PROVIDED ALL THE EVIDENCE TO THE OCR, WE'VE PROVIDED ATTORNEY'S LETTERS LAYING OUT OUR CASE, THE LAW, WHY WE BELIEVE THAT WE HAVE COMPLIED WITH THE LAW, AND SINCE MAY ALL WE'RE ASKING THEM IS SAY, THEY SENT US A LETTER INVITING US TO ENTER INTO A NEGOTIATION PROCESS. NOT A SINGLE FINDING, NOT A SINGLE ANALYSIS OF THE LAW, NOT A SINGLE PART OF ANY STATUTE THAT THEY'VE ACCUSED US OF VIOLATING, AND THEY'VE THROWN A RESOLUTION AGREEMENT, A VERY BROAD SWEEPING RESOLUTION AGREEMENT IN FRONT OF US SAYING, SIGN IT. SIGN IT AND WE'LL TELL YOU WHAT THE FINDINGS ARE AFTER YOU SIGN IT. THROUGH OUR RESEARCH, WE FEEL LIKE THIS IS A PATTERN THAT THE OCR ENGAGES IN, THEY BRING THE GREAT WEIGHT AND RESOURCES OF THE FEDERAL GOVERNMENT TO BEAR AGAINST SCHOOL DISTRICTS AND SAY, YOU SIGN WHAT WE TELL YOU TO A SIGN, AND THEN WE'LL TELL YOU AFTER THAT, WHAT YOU'RE GUILTY OF. WE'RE GOING TO PASS THE BILL BEFORE WE KNOW WHAT'S IN IT.
